Terms of Service and Usage Agreement
Parties
a) Alfo Sağlık İlaç ve Kimya Sanayi Ticaret Limited Şirketi, located at Caferağa Mah. Moda Cad. No:5 Kadköy / İstanbul, which operates the wiwify.com website (hereinafter referred to as Wiwify).
b) The internet user who becomes a member of the wiwify.com website (“Member”).
Subject of the Agreement
The subject of this Agreement is to determine the conditions under which the Member will benefit from the wiwify.com website owned by Wiwify.
Rights and Obligations of the Parties
3.1. The Member declares and undertakes that the personal and other information provided during membership on wiwify.com is accurate under the law, and that they will compensate Wiwify for all damages caused by the inaccuracy of this information immediately.
3.2. The Member may not share the password provided by Wiwify with other people or organizations. The right to use the password is exclusive to the Member. Therefore, all responsibilities and any claims and demands made by third parties or authorities against Wiwify due to unauthorized use will be the responsibility of the Member, and Wiwify reserves the right to claim compensation for any damages caused by unauthorized use.
3.3. The Member agrees to comply with all legal regulations while using the wiwify.com website and not to violate them. Otherwise, all legal and criminal liabilities will be entirely and exclusively the responsibility of the Member.
3.4. The Member may not use the wiwify.com website in any way that disrupts public order, is contrary to general morality, harasses or disturbs others, violates laws, or infringes on others' intellectual and copyright rights. The Member may not engage in activities that prevent or complicate the use of services by others (such as spam, viruses, Trojans, etc.).
3.5. The opinions, thoughts, and ideas expressed by the members on wiwify.com are solely their personal views and bind the individual expressing them. These opinions and thoughts are in no way related to or connected to Wiwify. Wiwify is not responsible for any damage caused by the opinions and thoughts expressed by the Member or by third parties.
3.6. Wiwify will not be responsible for unauthorized reading of member data or any damage caused to the Member's software and data. The Member has agreed in advance not to claim compensation from Wiwify for any damages arising from the use of the wiwify.com website.
3.7. The Member agrees not to access or use the software and data of other internet users without permission. Otherwise, all legal and criminal liabilities arising from this will be the responsibility of the Member.
3.8. If the Member violates one or more of the provisions of this Membership Agreement, the Member will be personally responsible for the legal and criminal consequences of this violation, and Wiwify will be indemnified from any legal and criminal responsibility arising from such violations. Furthermore, Wiwify reserves the right to claim compensation from the Member for breach of the membership agreement in the event the matter is taken to the legal field.
3.9. Wiwify reserves the right to delete the membership or remove files, documents, and information related to the customer at any time unilaterally. The Member agrees to this provision in advance. Wiwify is not responsible in this situation.
3.10. The software and design of the wiwify.com website are the property of Wiwify, and these are protected by copyright and/or other intellectual property laws. They cannot be used, acquired, or modified by the Member without permission. Other companies and product names mentioned on this site are their respective trademarks and are also protected under intellectual property rights.
3.11. Wiwify may collect certain information such as the name of the internet service provider used to access the site, the Internet Protocol (IP) address, the date and time of access, the pages accessed while on the site, and the web address that led to the site for the improvement and development of the wiwify.com website, and/or for legal purposes.
3.12. Wiwify may disclose the Member’s personal information when required by law or if (a) it needs to comply with legal requirements or legal processes served to Wiwify; (b) Wiwify believes it is necessary to protect and defend the rights and property of wiwify.com and the wiwify.com website family.
3.13. Measures have been taken within available resources to ensure that the wiwify.com website is free from viruses and similar malicious software. However, the final responsibility for ensuring security lies with the user, who must provide their own antivirus system and take necessary precautions. By entering the wiwify.com website, the Member accepts responsibility for any errors or their direct or indirect consequences in their software and operating systems.
3.14. Wiwify reserves the right to change the content of the site, modify or terminate any services provided to users, or delete the registered user information and data on the wiwify.com website at any time.
3.15. Wiwify can modify, update, or cancel the terms of this membership agreement at any time without prior notice or warning. Any modified, updated, or repealed provision will be valid for all members as of the publication date.
3.16. The parties agree that all computer records of Wiwify will be considered the sole and authentic evidence, in accordance with Article 287 of the Civil Procedure Code (HUMK), and these records will constitute an evidence contract.
3.17. Wiwify has the right to send informational emails and SMS messages to the electronic mail addresses and mobile phones of its members. By accepting this Membership Agreement, the Member agrees to receive informational emails and SMS messages.
Termination of the Agreement
This agreement will remain in effect until the Member cancels their membership or Wiwify cancels the membership. Wiwify can unilaterally terminate the agreement by canceling the membership if the Member violates any of the terms of this Membership Agreement.
Resolution of Disputes
In case of disputes regarding this agreement, the courts of Istanbul and the Enforcement Offices are authorized.
Effective Date
The Member’s registration means that they have read and accepted all the terms of this Membership Agreement. This Agreement is concluded and comes into effect upon the Member’s registration.
